These Terms of Use (“Terms”) are a legal agreement between you and Flatpath (“Flatpath,” “we,” “us,” or “our”) governing your use of the Flatpath mobile application and related services (the “Service”). This document also serves as the End User License Agreement (“EULA”) for the app. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the Service. If you use the Service on behalf of another person, you represent that you are authorized to accept these Terms for them.
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use.
Flatpath suggests walking routes optimized for flatness near a starting point you choose, and can provide on-screen navigation along a selected route. Route data, elevation estimates, flatness scores, distances, and maps are provided for general informational purposes and are generated using third-party data that may be incomplete, outdated, or inaccurate.
Routes and navigation are suggestions only. You are solely responsible for your own safety. Always stay aware of your surroundings, obey all traffic signals and local laws, use sidewalks and crossings, and use common sense. Do not rely solely on the app for navigation, and do not use the app in a way that distracts you from your surroundings. Routes may direct you along paths that are unsafe, closed, private, impassable, or otherwise unsuitable; elevation and flatness information may be wrong. Assess conditions yourself and choose a safe route. Flatpath is not a substitute for your own judgment.
You agree not to: (a) use the Service unlawfully or for any harmful purpose; (b) reverse engineer, decompile, or attempt to extract source code except as permitted by law; (c) scrape, overload, or interfere with the Service or circumvent usage limits or access controls; (d) resell or commercially exploit the Service or its data without our permission; or (e) infringe others’ rights.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. We and our licensors retain all rights in the Service. Map and routing data are provided by third parties (including Mapbox and openrouteservice, which use OpenStreetMap data © OpenStreetMap contributors) and are subject to their respective terms and attribution requirements.
The Service relies on third-party services (including Apple, Google/Firebase, Mapbox, openrouteservice, and RevenueCat). Your use of those services may be subject to their terms, and we are not responsible for third-party services or content.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or others. Sections that by their nature should survive termination will survive.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service, routes, or data will be accurate, reliable, uninterrupted, or error-free.
To the maximum extent permitted by law, Flatpath and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury or property damage, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $25.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Flatpath from claims and expenses arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-laws rules, except where your local consumer-protection laws grant you additional rights that cannot be waived.
These Terms are between you and Flatpath only, and not with Apple Inc. (“Apple”). The following apply to your use of the app obtained from the Apple App Store:
